Cottage leveling

We hired this contractor to level our cottage 3 years ago and after many excuses the job has yet to be completed and they are no longer returning our calls. Over a text message he wants to return part of our $4500.00 deposit because he is no longer interested in doing the job, we have a contract to have this job completed correctly and we do not believe it is sufficient to return some of the deposit when nothing was completed the correct way.
