New home build - many unresolved problems with home and lot

Problems with this company started on the day I signed the Agreement of Purchase authored by Park View for a new home build. The Agreement clearly states in Appendix A that there are no covenants on the lot I was purchasing. Subsequently, I found out there is an huge easement (over 10% of the size of my lot) for the city on my lot. Problem #2: Park View's Agreement forced me to pay for the Tarion warranty which has proven useless in my case. The thresholds are too big. For example, there are chips and bumps on my tiled floor which Park View refused to fix because these problems were under the size threshold dictated by Tarion. Problem #3: for 2 years I have been complaining to Park View that the grading of my lot was not done correctly. It does not match the grading plan for this development approved by the city. My complaints fall on deaf ears. Park View blames Schouten, but I paid Park View for my lot and home so it is Park View that should fix the problem (or hire someone to fix the problem). This grading issue has been on going for 2 years in Phase 2, and 7 years in Phase 1! As a result of numerous grading issues, there has been flooding on my neighbours' properties and in their sheds. And in many of the drainage ditches (including the one at the front of my house) the water does not flow properly but rather just sits in the ditch if there is a big rain fall. Because no one in Phase 1 or Phase 2 has been given the official grading certificates for our properties, no changes (such as fencing, landscaping, pools, etc.) should have been built since, technically, if Park View/Schouten ever do correct the grading, all the things landowners have built can be plowed under without compensation. Because of this, there is now a rift in the neighbourhood as some owners would like the grading fixed to be in compliance with the current grading plan appoved by the city, and others (some of whom have added fences, etc.) would not. It is interesting to note that one of the reason for these problems is that AFTER buying my lot, Park View/Schouten scrapped off hundreds of truck loads of topsoil from all the lots and hauled it away to other Park View developments in other towns. So I, and my neighbours, were left with homes built on top of individual hills, rather than on nice, high, flat land. Problem #4: The survey pins and stakes were missing on one side of my lot so I had to hire a survey company to put them in. Park View refuses to reimburse me for this expense even though they used those stakes when they later graded the lot next to mine. Problem #5: Park View will not allow you to talk to your contact on the phone. I am only allowed to communicate with her via email. She (a 'Service Coordinator Specialist') at Park View has ghosted me (refuses to answer my emails), so now none of my concerns are answered. Note: there are many more problems that I have encountered with this company. This review is just meant to be a sampling of the various categories of problems you will encounter with Park View if you buy from them. (fyi: I have bought a new home from another builder in the past and was very happy with that experience.) One final note: I have had very little success in getting Park View to fix the bigger ticket items (such as the water penetrating into my garage every time it rains), but a few of my neighbours, who acted more quickly and threatened lawsuits, have had more success in getting some things fixed. I would never buy from this builder again.
