United Fence and Deck were hired to place a chain link fence at the rear of the properties on Alldread Crescent in Newcastle. The owner of the business identified himself as Louis.
Only a number of the posts for the fence were erected over several weeks and and as a result, the company was advised that they were no longer required and were replaced by another company that completed the fence in two days.
While the owner of United Fence and Deck was in the area erecting the posts for the fence, he advised myself and several of the home owners that he could erect a gate in the fence for each household for a price of $375.00 if we gave him a deposit of $300.00. We agreed to this.
It was a short time later that his services were disposed of by the builder.
The work on the fence started sometime in August of 2012 and it was estimated that Louis and his crew worked approximately two and a half days. The property fence backs onto a public park and we had to obtain a permit to have a gate installed, that has been done and the permits are with the Municipality of Clarington through Mr. Peter Windolf.
My communication with Louis GAJTANO (This name came up as a result of a pocket dial from Louis) aka. GAJTANOUSKI commenced on December 5th, 2012.
I called Louis everyday (sometimes several times a day) up to December 12th when Louis called me back and advised he would be attending my address on Tuesday December 18th at 10.00am to install the gate.
Louis did not show up and I continued to call him again.
On December 20th, Louis called me and advised that he had two of his men quit and he would be attending my address on December 27th, 2012
Louis did not show up and I continued with my phone calls to his cell phone on December 28th.
I continued to call every day and every day I left a message when his voice mail was not full.
On January 9th, It appeared as though Louis cell phone was turned off as it indicated on the message to try again later.
I continued to try everyday and on January 15th his cell phone was activated again. I continued to leave him messages.
Today is January 17th, I left a message for Louis advising that I was taking this a step further and I was going to try and post something on the internet to warn other people about his business practises.
It is unfortunate that I did not get any documents from Louis advising me that he would be installing the gate, however, we do have the cancelled cheque for the $300.00 we paid him.

Over the past couple of months Louis was supposed to get back to me with money. Apparently he sold the house on Linden Avenue and then negotiated to get $50,000.00 in a certified cheque that would go into his wife's bank account and he was going to pay the money back that he owed all of us. NOT. Arrangements were made for him to meet me, NOT.
I’ve left him a voice mail message and a text on each of his two cell phones over the past three weeks and he hasn’t responded.
I’m going to take him to small claims court, I have the documents and then I’m going after the money and all expenses that I can get from him. If he refuses to pay then I will have items that he owns seized and sold if necessary.
He wanted me to retract the message I left on the web if he repaid the money owing, I advised him that I would if the money was paid back.
